1. Acceptance of Terms

By accessing and using Bootminds ("we," "our," or "us") website and services, you accept and agree to be bound by the terms and provision of this agreement. These Terms of Service apply to all visitors, users, and clients of our Global Capability Center consulting services.

If you do not agree to abide by the above, please do not use this service.

2. Service Description

Bootminds provides the following consulting services:

  • GCC setup and launch consulting (90-day methodology)
  • GCC expansion and scaling services
  • Executive hiring and leadership recruitment
  • SkillStack™ staffing solutions
  • Market intelligence and strategic advisory
  • ROI analysis and decision support tools

All services are provided on a professional consulting basis with specific deliverables, timelines, and quality standards as outlined in individual service agreements.

3. User Accounts and Responsibilities

3.1 Account Creation

Some services may require account creation. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3.2 User Obligations

You agree to:

  • Provide accurate and complete information
  • Use services only for lawful business purposes
  • Not interfere with service operations
  • Respect intellectual property rights
  • Maintain professional communication standards

3.3 Prohibited Activities

You agree not to:

  • Use services for illegal activities
  • Transmit harmful or malicious content
  • Attempt to gain unauthorized access
  • Violate any applicable laws or regulations
  • Impersonate others or misrepresent affiliations

4. Service Terms and Deliverables

4.1 Service Level Agreements

Our services include specific SLAs and deliverables as outlined in individual project agreements. Key commitments include:

  • 90-day GCC setup methodology with milestone SLAs
  • 25-day executive hiring promise
  • SkillStack™ staffing delivery guarantees
  • Transparent pricing with no hidden fees
  • Zero-risk engagement clauses

4.2 Project Management

All projects include dedicated project management, regular progress updates, and quality assurance processes to ensure successful delivery.

5. Intellectual Property

5.1 Our Intellectual Property

All content, methodologies, tools, and materials provided by Bootminds, including but not limited to SkillStack™, GCC launch blueprints, and market intelligence reports, remain our intellectual property.

5.2 Client Materials

You retain ownership of materials, data, and information provided to us for service delivery. You grant us a limited license to use such materials solely for providing the contracted services.

5.3 Deliverables

Upon full payment, you receive full rights to project deliverables, excluding our proprietary methodologies and tools.

6. Payment Terms

6.1 Pricing and Fees

All pricing is transparent and agreed upon in writing. Our fee structure includes:

  • Consulting fees for GCC setup and advisory services
  • Executive search and recruitment fees
  • Staffing placement fees (SkillStack™ model)
  • Market intelligence and research subscriptions

6.2 Payment Terms

Payment terms are specified in individual service agreements. Standard terms include:

  • Deposit required to initiate services
  • Milestone-based payments for project work
  • Net 30 payment terms for approved clients
  • Late payment fees (1.5% per month)

6.3 Refunds

Refunds are provided according to specific service guarantees. Our zero-risk engagement model includes refund provisions for unmet deliverables.

7. Confidentiality

Both parties agree to maintain confidentiality of proprietary information, client data, and business strategies shared during the course of service delivery. This obligation continues indefinitely for truly confidential information and for a minimum of 5 years for project-related information.

8. Limitation of Liability

Bootminds' liability is limited to the amount paid for services in the preceding 12 months. We are not liable for consequential damages, lost profits, or indirect losses. Our services are provided "as is" with professional due care and industry-standard practices.

9. Termination

Either party may terminate services with 30 days written notice. Upon termination, we will complete all work in progress and provide final deliverables. Outstanding payments become immediately due.

10. Governing Law

These terms are governed by the laws of India. Any disputes will be resolved through arbitration in Bangalore, Karnataka, with Indian law applying to all matters.

11. Dispute Resolution

We encourage amicable resolution of disputes. Unresolved disputes will be submitted to binding arbitration under Indian Arbitration and Conciliation Act, 1996.

12. Modifications to Terms

We reserve the right to modify these terms with reasonable notice. Continued use of our services constitutes acceptance of updated terms.
